01 General provisions
These General Terms and Conditions of Sale (hereinafter, the “General Conditions”) apply to all sales of products (hereinafter, the “Products” or the “Product”) purchased through the website www.madonieat.com (here, the “Website”).
The use of the distance selling service described in these General Conditions is reserved exclusively for consumers (hereinafter, the “Customers” or the “Customer”), meaning natural persons acting for purposes unrelated to any commercial, business, entrepreneurial or professional activity they may carry out.
The language available for concluding the contract is English.
The Customer is required to carefully read the General Conditions, which are made available on the Website, in order to allow their storage and reproduction by the Customer pursuant to Article 12 of Legislative Decree No. 70 of 9 April 2003.
Contracts concluded with Madonie For Eat Srl (as defined below) through the Website are governed by Italian law and, in particular, by Legislative Decree No. 206 of 6 September 2005 (“Consumer Code”) and Legislative Decree No. 70 of 9 April 2003 (hereinafter, the “E-commerce Decree”).

03 Product information
Information relating to Products available for distance sale through the Website, including product codes, is available on the Website. Such information is provided in accordance with Articles 52 and 53 of the Consumer Code.
04 Price
Product prices include all applicable taxes and duties. All prices are expressed in Euro (€). Shipping costs are borne by the Customer, unless otherwise stated in promotional offers, and can be consulted on the shipping costs page.
05 Product orders
The essential characteristics and prices of the Products are indicated in the offer relating to each Product. In order to purchase the Products, the Customer must complete and submit the electronic order form online, following the instructions on the Website. The Customer must add the Product to the “cart” and, after reviewing the General Conditions, with particular reference to shipping costs, the right of withdrawal, and the Privacy Policy, must select the preferred payment method and choose the option “Confirm Order”. Before submitting the purchase order, the Customer will have the opportunity to correct any data entry errors by following the relevant modification procedure available on the Website. In particular, the Customer may modify the quantity of Products intended for purchase by adding or removing one or more Products from the “cart”.
By submitting the order, the Customer acknowledges and declares to have reviewed all information provided during the purchase procedure and to fully accept these General Conditions. The Customer will be able to view and monitor the status of the order through the “Orders” section of their account. Madonie For Eat reserves the right to evaluate and accept the orders received. Madonie For Eat will inform the Customer of any inability to accept the received orders within 30 (thirty) days from the day following the date on which the Customer submitted the order, and will refund any amounts already paid by the Customer for the purchase.
06 Payment methods
The Customer may pay the price of the Products and related delivery costs by debit card, credit card, or PayPal (via secure and protected PayPal server).
Payments made with all major credit cards are accepted, including Visa, MasterCard and American Express.
The transaction will be charged to the Customer’s credit card only after:
- the credit card details have been verified (directly on PayPal secure server; we do not have any direct access to your data),
- authorization has been received from the company issuing the credit card used by the Customer
- product availability has been confirmed by Madonie For Eat.
If, for any reason, the charge of the amounts due by the Customer is not possible, the sales process will be automatically cancelled and the sale will be void.
07 Order confirmation
In accordance with Article 53 of the Consumer Code, the Customer will receive, at the time of contract execution, an email confirming receipt of the purchase order submitted by the Customer. This confirmation will include a summary of the General Conditions, the essential characteristics of the ordered product, its price, the amount paid, the existence of the right of withdrawal (including the timeframe and procedure for returning the goods), the geographical address for submitting complaints, and information regarding customer support services and any existing commercial warranties.
08 Invalidity of the Order
No contract shall be deemed concluded between Madonie For Eat and the Customer if Madonie For Eat has reasonable grounds to believe that the Customer is not acting on the basis of a genuine interest in purchasing the ordered products, or if the Customer abuses the right of withdrawal as provided under Article 12 below. In such cases, the order submitted by the Customer shall be deemed ineffective. Madonie For Eat will notify the Customer by email of the non-conclusion of the contract and will cancel any charges and/or expenses borne by the Customer.
09 Shipping and Delivery
Products purchased on the Website will be delivered to the address provided by the Customer. The Customer may also request delivery to another natural person of their choice, whose residence or domicile is located within Italy, the EU, or outside the EU (shipping availability depending on the destination country).
Upon delivery, the signature of an adult over 18 years of age will be required. Deliveries will not be made to P.O. boxes.
For each order placed on the Website, Madonie For Eat issues an invoice for the shipped goods, sending it by email or post to the order holder, pursuant to Presidential Decree 445/2000 and Legislative Decree 52/2004. The information provided by the Customer at the time of the order will be used for invoice issuance.
No changes to the invoice will be possible after it has been issued.
Delivery costs are borne by the Customer and are clearly indicated on the Website and in the order form. All purchases will be delivered by express courier selected by the Customer during checkout among those proposed by Madonie For Eat (hereinafter, the “Courier”), from Monday to Friday, excluding public holidays and national holidays. Madonie For Eat is not responsible for unforeseeable delays.
Madonie For Eat will send the Customer a confirmation email once the Products have been shipped, specifying the shipment tracking number, which can be used to check the shipping status on the Courier’s website.
In any case, except in cases of force majeure or unforeseeable circumstances, pursuant to the Consumer Code, Products will be delivered within a maximum of 30 (thirty) days from the day following the date on which the Customer submitted the order to Madonie For Eat, unless Madonie For Eat notifies the Customer by email within the same timeframe of the impossibility of delivering the ordered goods due to the unavailability, even temporary, of the Products. In such case, Madonie For Eat will refund any amounts already paid by the Customer.
If, following communication of a delay by Madonie For Eat, the Customer wishes to cancel the order, any amount already paid will be refunded as soon as possible and in any case no later than 30 (thirty) days from the day following the date on which the Customer submitted the order.
Delivery requires the presence of the Customer or a delegated person at the indicated delivery address. At the time of delivery, the Customer must check that the number of packages corresponds to what is stated in the transport document and that the packaging is intact and not damaged.
Any damage to the package and/or Products or any discrepancy in the number of packages must be immediately reported by making a written reservation on the Courier’s delivery receipt. Once the Courier’s document has been signed, the Customer may not raise any objection regarding the external condition of the delivered package.
10 Product Replacement
Madonie For Eat offers Customers the possibility to replace Products purchased through the Website. To request the replacement of a Product, the Customer must follow the same procedure described above for returns. If the Customer is not fully satisfied, they must keep all documentation relating to delivery and the Product in its original packaging, and contact Madonie For Eat immediately by email at Madonieat@gmail.com.
The Product to be replaced must be returned, in normal condition of preservation, to the following address:

The processing of the new order is subject to the availability of the requested Products.
Shipping costs for returning the Product are borne by the Customer. The replacement Product will be sent to the Customer by courier, with shipping costs charged to the Customer.
11 Lack of conformity
In case of lack of conformity of Products sold by Madonie For Eat through Madonieat.com, the Customer must immediately contact our Customer Service at Madonieat@gmail.com.
The legal warranties provided under Articles 129, 130 and 132 of the Consumer Code apply to the sale of Products.
The Customer is entitled to have the conformity of the goods restored free of charge through repair or replacement, or to obtain an appropriate price reduction or termination of the contract. The Customer loses these rights if they do not notify Madonie For Eat of the lack of conformity within two months from the date the defect was discovered. In any case, any claim regarding defects not fraudulently concealed by Madonie For Eat shall expire within 26 (twenty-six) months from delivery of the goods.
12 Errors
Product information provided on the Website is constantly updated. However, the complete absence of errors cannot be guaranteed.
Madonie For Eat reserves the right to correct errors, inaccuracies or omissions even after an order has been submitted, and also to change or update information at any time without prior notice.
13 Applicable Law and Jurisdiction
These General Conditions are governed by Italian law and must be interpreted in accordance with Italian laws. For any disputes arising from the interpretation, validity and/or execution of these General Conditions, exclusive jurisdiction shall lie with the Court of Palermo.
